Dubai is one of the largest cities in the United Arab Emirates (UAE). Small start-up practices are on the rise, with lawyers and foreign investors choosing to open a law firm or business in Dubai because of the favourable economic stability and the fact that that foreign direct investment is encouraged in the area.

People are also attracted by the benefits of being self-employed and the potential to profit directly from their own hard work, instead of working to demanding targets and lining other business owner’s pockets.

When opening a business in Dubai, it is advisable to seek the help of a specialised professional who understands the complexities and process. Any investment in Dubai should be carefully considered. There are certain special permits and licenses as well as approvals from the government ministries that are required. These will depend on your circumstances.

Dubai Background

UAE is one of the most well known and respected markets in the Middle East for starting a law firm. Dubai is a leading trading area and one of the most attractive places for entrepreneurs to start a law firm. The area promoted attractive policies that include no tax, business-friendly regulation, protection of assets and privacy/security.

The region derives its civil law mostly from French, Roman, Islamic and Egyptian law influences. This system is very different to the UK which uses legal precedents. In the UAE, common law principles are usually not recognised.

Legal System

The United Arab Emirates is comprised of two dual court systems: civil courts and Sharia courts.

These two courts cover different aspects of the law and each Emirate has a separate federal court.

Lawyers in Dubai primarily focus on construction, corporate, commercial contracts and disputes/litigation, energy, commercial property and finance/banking.

Dubai lawyers can work as sole practitioners, in partnerships or as part of a civil company.

The federal and local courts are the dual courts in Dubai with the Supreme Court based in Abu Dhabi. There are 3 stages to the Dubai court system,

  1. Court of First Instance
  2. Court of Appeal
  3. Court of Cassation.

How Do I Open a Law Firm in Dubai?

To open a law firm in Dubai, you will need to work in partnership with a local lawyer who has at least 51% of the business and who has a law license which is valid in at least the First Instance Court, or, you may establish the business in Dubai’s free trade zones for 100% ownership.

You will need to have a law degree in order to acquire a license from the Ministry of Justice. Once you get your documents and details, this will allow you to open a law firm.

There are other regulatory tasks you will need to complete to finalise the opening of your firm.

Regulatory Compliance

Lawyers and advocates must register locally with the Ministry of Justice to practice in the area.

To provide legal services outside the court, lawyers need to get licensed with registration documents from the Department of Legal Affairs.

Only local lawyers can attend court. Foreign lawyers however can practice law. In litigation matters and federal Supreme courts, only registered lawyers can represent clients and appear before the courts.

Other Restrictions

Lawyers and Law firms in Dubai are subject to the discretion of the Ruler’s court. Lawyers that are otherwise qualified to practice law in the country may be required by an individual Emirate to operate an office in that Emirate to practice law locally in that region.
